The short version: use the site reasonably, treat quotes as estimates not contracts, understand that used totes are sold to their stated grade, and know that California law governs any dispute.

These Terms of Service (“Terms”) govern your use of ibctotescalifornia.com and any information, quotes, or transactions you obtain through it from IBC Totes California(“we,” “us,” or “our”). By using the site, you agree to these Terms. If you do not agree, please do not use the site.
Use of this website
You may use this site for lawful, business-to-business purposes: to learn about IBC totes, request quotes, and arrange purchases, sales, reconditioning, or transport. You agree not to misuse the site, attempt to disrupt it, scrape it at scale, or use it to violate any law or third-party right. Content on the site is provided for general information about our products and services.
Quotes are non-binding estimates
Any pricing, availability, lead time, or specification we provide through the site or by email is a good-faith estimate, not a binding offer or contract. Prices and inventory change with tote condition, volume, grade, and market conditions. A sale is only confirmed once we and you agree on specific terms in writing (including quantity, grade, price, and delivery) and, where applicable, payment is arranged. We may decline or cancel any order before it is fulfilled.
Product condition & grade
We sell used, reconditioned, and new IBC totes. Used and reconditioned totes are pre-owned goods sold to a stated grade (for example food-grade, technical, rinsed, or as-is), as described on our Grades Explained page. Grade describes cleaning level and intended use, not a guarantee of suitability for your specific application. Minor cosmetic wear, labeling, and variation are normal on used totes.
You are responsible for confirming that a given tote and its grade are appropriate and compatible for your intended contents and use — including chemical compatibility, food-contact suitability, and any transport (UN) markings your application requires. When in doubt, ask us before you fill a tote, and consult the relevant safety data sheet for your product.
No warranty beyond the stated grade
Except for the grade and condition expressly stated for a specific tote at the time of sale, our products are provided “as is,” and we disclaim all other warranties to the fullest extent permitted by law, including any implied warranties of merchantability or fitness for a particular purpose. Information on this site is provided without warranty of any kind. We do not warrant that the site will be uninterrupted or error-free.
Limitation of liability
To the fullest extent permitted by law, IBC Totes California will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising out of or related to your use of the site or our products. Our total liability for any claim relating to a product will not exceed the amount you paid us for that product. You are responsible for the safe, lawful use, cleaning, storage, and transport of any tote you acquire from us.

The site may reference or rely on third-party services (such as our lead-management processor described in our Privacy Policy). We are not responsible for the content or practices of third parties.
Intellectual property
The text, design, and branding on this site are owned by IBC Totes California or used with permission. You may not reproduce or reuse them without our written consent, except for ordinary personal or business reference.
Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or your use of the site will be subject to the exclusive jurisdiction of the state and federal courts located in California.

We may update these Terms from time to time. Changes take effect when posted, and we will update the “Last updated” date above. Continued use of the site after changes means you accept the revised Terms.
